The Merchant covenants to deposit and continuously maintain an unencumbered, liquid cash security bond within the segregated ICIA ADRPS Escrow Trust Account maintained with an authorized tier-1 financial institution in London:

The Merchant hereby grants the ADRPS Fund Trustees and OA-COM Tribunal an unconditional, irrevocable power of attorney to unilaterally debit funds from the Merchant’s escrow balance to execute valid arbitral restitution awards, blind testing laboratory fees, and administrative filing expenses without requiring notice to, or subsequent counter-authorization from, the Merchant.
The ADRPS framework guarantees that verified consumer claims are settled via liquid advance payout prior to prolonged cross-border civil litigation:
Upon issuance of a Final Arbitral Restitution Award by OA-COM confirming non-conformity (e.g. undisclosed [RC] polymer filling, [C/D] chemical dyeing, undisclosed synthetic species, or grade inflation variance >1 sub-grade), the ADRPS Trustees shall wire 100% of the invoice purchase amount plus re-testing fees and insured courier costs directly to the claimant within 14 business days from the formal registration of the Notice of Dispute.
Whenever a debit is executed against the Merchant’s escrow account, the Merchant must replenish the account to the mandatory minimum statutory balance within ten (10) business days following notice from the Secretariat. Failure to effect full replenishment within 10 days triggers immediate automatic sanctions:
• Immediate Yellow Card status and total suspension of cert.icia.uk digital twin minting and certificate validation privileges;
• Permanent Red Card expulsion and total forfeiture of remaining bond balances if default exceeds twenty (20) business days, followed by worldwide industry blacklisting.
The parties hereby adopt the following uniform arbitration agreement, which governs all transactions, certificate guarantees, and commercial representations:
“Any dispute, controversy, difference, or claim arising out of, relating to, or in connection with the authenticity, grading, treatment disclosure, or physical condition of any crystal, gemstone, or mineral specimen bearing an ICIA certificate (CCGS/MSGS/RCGS/OAISS) or sold by an accredited CABCS merchant, including any question regarding the existence, validity, interpretation, performance, breach, or termination of this Agreement, shall be referred to and finally resolved by arbitration administered by the OA-COM Supreme Arbitration Tribunal under the ADRPS Arbitration Rules in force at the time of the commencement of arbitration.”

Awards rendered by the OA-COM Supreme Tribunal are final, binding, and non-appealable on the merits. The parties irrevocably waive any right to appeal, review, or recourse to state courts or judicial authorities, insofar as such waiver can validly be made under applicable law.
The parties acknowledge that all awards rendered hereunder constitute arbitral awards subject to recognition and enforcement pursuant to the 1958 United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the New York Convention). In the event that escrow balances are depleted, the prevailing party may immediately register the award with any competent judicial court across all 170+ contracting states for direct attachment of the defaulting party’s commercial bank accounts, inventory, and assets.
The ADRPS Tribunal enforces strict loser-pays cost-shifting principles to deter frivolous contestations:
The Merchant hereby certifies that it has examined all provisions of this Agreement, accepts irrevocable OA-COM arbitration, and irrevocably authorizes ADRPS escrow debits.
